Effectory s. r. o. operates PPWR Support and decides how enquiry information is used. Send privacy questions or requests to the email address above.

2. Personal data we process

When you submit the embedded Tally form, Effectory receives the email address and PPWR question you are required to provide, plus your company name if you choose to include it. Without the required email address and question, we cannot review or respond to the enquiry. The question may contain personal data that you include in its text. Please do not include confidential technical documents, special-category personal data or unnecessary personal details about other people in the initial form.

If you ask us to prepare a proposal or accept one, we may also process related email correspondence, information needed to define and deliver the agreed work, and invoicing details requested separately. The initial website form does not request an account, payment details, postal address or file upload.

To deliver and secure the website and embedded form, their providers may process technical information generated by use of the page, such as log, usage, device, cookie or similar technology data. The exact technical data depends on the provider and its current configuration.

3. Purposes and legal bases

  • Review and answer a business enquiry: We use the information to understand the question, decide whether we can assist, contact you and, where appropriate, prepare a proposed scope, fixed price and delivery time. Where you contact us on behalf of a company, we rely on our legitimate interests under Article 6(1)(f) GDPR in receiving and responding to B2B enquiries and managing related business communications.
  • Pre-contractual steps and an agreed assignment: Article 6(1)(b) GDPR applies where you are personally requesting steps towards a contract with Effectory or are personally the customer, such as when acting as a sole trader. Where a company is the customer and you act as its representative, we generally rely on legitimate interests to manage the business relationship.
  • Invoices and legal records: If an assignment proceeds, some information may be processed to meet applicable accounting, tax or other legal obligations under Article 6(1)(c) GDPR.
  • Website operation and security: Effectory and its providers may process technical data as needed to deliver, maintain and protect the website and form. Effectory relies on its legitimate interest in operating a secure service.

Submitting an enquiry is not consent to marketing. Effectory does not use enquiry details for newsletters or unrelated promotional email. Where processing is based on legitimate interests, you may object on grounds relating to your situation.

4. Recipients and service providers

  • Effectory s. r. o. reviews enquiries and responds by business email. Access is limited to people who need the information for that work.
  • Tally BV provides the form. Tally states that it acts as a processor for form responses, stores submissions in the form creator's account and allows the form creator to export or delete them. Tally also sends the configured submission notification to Effectory.
  • Tally service providers. Tally's published list identifies Google Cloud in Belgium for hosting and storage, and SendGrid in the United States for email notifications. Tally says SendGrid may process submissions when form email notifications are enabled; notifications are enabled for this form. Tally also identifies Cloudflare in the United States for DNS and bot protection and says it does not process form submissions. See Tally's GDPR and subprocessor information and Data Processing Agreement.
  • Microsoft 365 / Outlook receives the Tally notification and is used for Effectory's email replies. Notification messages and subsequent correspondence may therefore be held in the Effectory mailbox under the terms applying to that Microsoft account.
  • OpenAI hosts and operates this ChatGPT Site and may process information provided through the Site and technical information generated through its use. The OpenAI terms and Data Processing Addendum applicable to the Site govern that processing. See the ChatGPT Sites Terms and ChatGPT Sites Data Processing Addendum.
  • We may disclose information to professional advisers or public authorities where needed to obtain advice, meet a legal obligation or respond to a lawful request.

There is no customer account, online checkout, marketing platform or separate Effectory database connected to this enquiry flow.

5. Storage locations and international transfers

Tally states that form data is stored in Europe; its current subprocessor information identifies Google Cloud in Belgium for hosting and storage. Tally also lists SendGrid in the United States for email notifications and says it may process form submissions when notifications are enabled. Tally's published Data Processing Agreement incorporates the EU Standard Contractual Clauses for transfers covered by those clauses. The form creator can export or delete submissions; Tally says deleted form data is removed from backups within 90 days, unless the Tally Trash is emptied sooner.

OpenAI hosts this ChatGPT Site. ChatGPT Sites does not provide data residency. The OpenAI Sites Data Processing Addendum applicable to the account governs any international processing; for EEA and Swiss data transferred by OpenAI Ireland Limited outside those regions, its published DPA specifies Standard Contractual Clauses or an adequacy decision. Effectory does not claim that all Site data remains within the EEA. See OpenAI's guidance for ChatGPT Sites privacy policies.

The Tally notifications and email replies are handled through Effectory's Microsoft 365 / Outlook mailbox. The location of Microsoft 365 data depends on the tenant and service configuration. Microsoft's applicable Online Services Data Protection Addendum governs processing for in-scope services and provides transfer safeguards, including EU Standard Contractual Clauses where applicable. No fixed mailbox region or EU-only storage is promised. See Microsoft's Products and Services Data Protection Addendum and Microsoft 365 data locations.

6. How long information is kept

Effectory keeps enquiry information only for as long as reasonably necessary to review and answer the enquiry, communicate with you and assess a possible assignment. Enquiries that do not lead to an assignment are not kept indefinitely and will be deleted or anonymised when they are no longer needed for those purposes, subject to any continuing legitimate need or legal preservation obligation.

When the PPWR Support pilot is concluded, Effectory will carry out a one-time cleanup of unused enquiries and related correspondence. No automatic deletion is configured in Tally. Tally states that the form creator can delete submissions and that deleted form data is removed from Tally backups within 90 days, unless the Tally Trash is emptied sooner. Copies in the Outlook mailbox are handled under the same retention criteria. Information relating to paid assignments may be kept for as long as necessary to deliver the work and meet contractual, accounting or other legal obligations.

7. Your data protection rights and complaints

As a data subject under the GDPR, you may, subject to its conditions, request access to your personal data, correction, deletion, restriction of processing or data portability. You may object to processing based on legitimate interests. To exercise a right, contact info@effectory.sk. We may ask for proportionate information to confirm your identity before acting on a request.

You may also lodge a complaint with the supervisory authority in your habitual residence, place of work or place of the alleged infringement. In Slovakia, this is the Office for Personal Data Protection of the Slovak Republic.

8. Cookies and similar technologies

Effectory does not add analytics, advertising pixels or marketing trackers to this website. The enquiry form is embedded from Tally. Tally states that it does not use cookie tracking and that its published website uses essential cookies only. OpenAI hosts this ChatGPT Site and may process technical information, including device, log, usage and cookie or similar technology data, to provide and operate the service. No optional analytics or advertising technology is configured by Effectory. Any essential or technical cookies used by Tally or OpenAI are subject to their respective service terms and notices. See Tally's Privacy and Cookie Notice and OpenAI's ChatGPT Sites privacy guidance.

9. Changes and contact

We may update this policy when the enquiry process, providers or applicable requirements change. The latest version will be posted on this page.
